Protected Trade Terms & Conditions
These terms govern all Protected Trades completed through PLUR Market.
Please read them carefully before participating in a trade.

$10 PLUR Market Trade Fee
Each trader pays a $10 PLUR Market Trade Fee plus their applicable shipping costs.
Both Traders Must Pay
Each trader receives a Stripe payment link by email. Shipping labels are not issued until both traders have paid. If one trader pays and the other does not complete payment within the required window, the trade may be cancelled and the paying trader's payment will be refunded or voided, as applicable. Neither trader will be charged for that cancelled trade.
3 Days to Ship
Once both traders have paid and PLUR Market issues the shipping labels, both traders have 3 days to ship their merchandise to PLUR Market unless an extension is authorized.
$40 Trade Cancellation/Resolution Fee
After shipping labels are issued, failure to ship, sending merchandise that materially differs from the approved trade, unauthorized cancellation, or otherwise causing the trade to fail may result in a $40 Trade Cancellation/Resolution Fee.
ALL COMPLETED TRADES ARE FINAL
Once PLUR Market verifies both items and completes the exchange by forwarding them to their new owners, there are no returns or exchanges except where required by applicable law or otherwise expressly authorized under these Terms.
These Protected Trade Terms & Conditions (“Trade Terms”) govern participation in the Protected Trades service offered by PLUR Market LLC (“PLUR Market,” “PLUR,” “we,” “us,” or “our”).
These Trade Terms supplement PLUR Market's general Terms of Service, Privacy Policy, and other policies applicable to the PLUR Market platform. If a provision of these Trade Terms conflicts with the general Terms of Service specifically regarding a Protected Trade, these Trade Terms will control with respect to that Protected Trade.
By creating a Trade Listing, agreeing to a trade, submitting or accepting a Trade Order, making a required payment, shipping merchandise as part of a Protected Trade, or otherwise participating in the Protected Trades service, you acknowledge that you have read, understood, and agreed to these Trade Terms.
1. Protected Trades
PLUR Market Protected Trades allow eligible users to exchange merchandise with one another using PLUR Market as an intermediary.
Under the standard Protected Trade process, traders communicate through PLUR Market, agree on the merchandise to be exchanged, and submit the agreed transaction to PLUR Market through a Trade Order.
After PLUR Market approves the Trade Order and both traders complete their required payments, PLUR Market provides each trader with a shipping label to send their merchandise to PLUR Market.
PLUR Market will generally wait until both items have been received and verified before forwarding the merchandise to the respective receiving traders.
Traders must not ship merchandise directly to one another as part of a Protected Trade unless PLUR Market expressly instructs them to do so.
Protected Trades currently support item-for-item exchanges only. Trades involving additional cash consideration between traders are not currently supported unless PLUR Market expressly introduces and authorizes such functionality.
2. Eligibility
To participate in Protected Trades, you must:
- Have an eligible PLUR Market account;
- Provide accurate account and contact information;
- Have the legal right to possess and transfer the merchandise being traded;
- Comply with these Trade Terms and all other applicable PLUR Market policies;
- Comply with applicable federal, state, and local laws; and
- Complete any verification, payment, or other requirements requested by PLUR Market.
PLUR Market may restrict, suspend, or deny access to Protected Trades when reasonably necessary to protect users, PLUR Market, or the integrity of the marketplace.
3. Trade Listings
Trade Listings must accurately represent the
actual merchandise being offered for trade.
Traders must provide reasonably accurate information regarding their merchandise, including, where applicable:
- Item type;
- Artist, brand, or manufacturer;
- Size;
- Condition;
- Material flaws, damage, alterations, or defects;
- Relevant identifying information;
- Estimated trade value; and
- Clear photographs of the actual merchandise being offered.
Stock photographs, misleading photographs, intentionally concealed damage, materially inaccurate descriptions, or other deceptive representations are prohibited.
Normal differences in lighting, photography, display settings, measurements, and reasonable subjective assessments of used-item condition may occur. Traders should ask questions and review all available information before agreeing to a trade.
4. Communication Between Traders
Traders are responsible for communicating with one another before agreeing to a trade.
Before submitting a Trade Order, both traders should confirm all material terms of the proposed exchange, including the exact merchandise being exchanged, size, condition, known flaws or damage, included components or accessories, and any other details important to either trader.
PLUR Market encourages traders to conduct trade-related communications through the PLUR Market platform so relevant communications may be available if an issue arises.
5. Trade Orders
Once two traders reach an agreement, one trader must submit a
Trade Order containing the information requested by PLUR Market.
The Trade Order should accurately describe the complete agreement between the traders. By submitting or agreeing to a Trade Order, each participating trader represents that the information contained in the Trade Order accurately reflects the trade they agreed to complete.
A submitted Trade Order is
not automatically approved. PLUR Market may review the Trade Order, request additional information, require clarification, decline the proposed trade, or impose reasonable requirements before approving it.
DO NOT SHIP YET.
Do not ship merchandise merely because a Trade Order has been submitted or approved. Traders must wait until PLUR Market approves the Trade Order, both traders complete their required payments, and PLUR Market provides the applicable shipping labels and instructions.
6. $10 PLUR Market Trade Fee and Shipping Costs
Each trader participating in a Protected Trade is responsible for:
A $10 PLUR Market Trade Fee, plus that trader's applicable shipping costs.
The $10 Trade Fee is the portion retained by PLUR Market as its fee for facilitating and administering the Protected Trade.
Shipping amounts collected in connection with a Protected Trade are used to cover applicable shipping costs associated with completing the Protected Trade process and are not an additional PLUR Market Trade Fee.
Shipping costs may vary depending on package characteristics, destination, carrier rates, insurance requirements, and other applicable shipping factors.
Both traders must complete their required payments before PLUR Market will issue shipping labels or authorize merchandise to be shipped.
7. Stripe Payment Links
After PLUR Market reviews and approves a Trade Order, each trader will be emailed a secure Stripe payment link for their individual Protected Trade charges.
The payment request will include the applicable $10 PLUR Market Trade Fee and shipping costs associated with that trader's participation in the Protected Trade.
Each trader is responsible for completing their own payment using the Stripe payment link provided.
PLUR Market will not send shipping labels to either trader until both traders have completed their required payments.
Once both payments have been successfully completed, PLUR Market will provide the applicable shipping labels and shipping instructions to both traders.
Payments may be processed through Stripe or another payment processor designated by PLUR Market and may be subject to the payment processor's applicable terms.
8. Both Traders Must Pay Before the Trade Proceeds
A Protected Trade proceeds to the shipping stage only after
both traders have completed their required payments.
Both traders must complete payment within the payment window communicated by PLUR Market.
If one trader completes payment and the other trader fails to complete payment within the required payment window, PLUR Market may cancel the Trade Order.
If one trader pays and the other does not:
Neither trader will be charged for the cancelled trade. Any payment already submitted by the trader who completed payment will be refunded or voided, as applicable.
The paying trader will not lose their $10 Trade Fee or shipping payment because the other trader failed to pay.
The trader who failed to complete the initial payment will also not be assessed the $40 Trade Cancellation/Resolution Fee solely because they failed to pay before shipping labels were issued.
If the traders later decide to proceed, PLUR Market may require a new Trade Order.
9. Shipping Labels and Three-Day Shipping Window
Once PLUR Market has approved the Trade Order and both traders have completed their required payments, PLUR Market will provide each trader with the applicable prepaid shipping label and shipping instructions.
The three (3) day shipping window begins when PLUR Market issues the shipping labels.
Each trader then has three (3) days to ship their merchandise to PLUR Market unless PLUR Market provides a different deadline or expressly grants an extension.
A package is considered shipped when it has been properly tendered to the designated carrier and the carrier has recorded acceptance or possession of the shipment.
Creating, downloading, or printing a shipping label does not constitute shipping the merchandise.
If circumstances prevent a trader from shipping within the required period, the trader should contact PLUR Market as soon as possible.
IMPORTANT FEE POLICY
10. Failure to Ship After Labels Are Issued — $40 Trade Cancellation/Resolution Fee
Once
both traders have paid, PLUR Market has issued the shipping labels, and the three-day shipping window has begun, both traders are expected to complete the agreed trade.
PLUR Market may assess the responsible trader a
$40 Trade Cancellation/Resolution Fee if a trader:
- Fails to ship within the required three-day period without an authorized extension;
- Abandons the trade after shipping labels have been issued;
- Refuses to complete their agreed portion of the transaction;
- Sends merchandise materially different from the approved Trade Order;
- Causes the trade to fail because of their violation of these Trade Terms; or
- Otherwise causes the approved trade to require cancellation or unwinding.
The $40 fee is intended to offset costs associated with resolving or unwinding the failed trade, including, as applicable, shipping merchandise back to one or both traders, return labels, previously issued labels, payment-processing expenses, administrative expenses, and other reasonable operational costs.
The $40 fee is separate from the standard $10 Trade Fee and applicable shipping costs.
The $40 fee does not apply merely because a trader fails to complete the initial Stripe payment before shipping labels have been issued.
PLUR Market may waive, reduce, or modify the fee when circumstances reasonably warrant doing so.
11. Packaging Requirements
Each trader is responsible for securely packaging their merchandise for shipment to PLUR Market. Packaging must be appropriate for the merchandise and reasonably designed to protect it during normal carrier handling.
- Use appropriately sized packaging;
- Protect delicate or collectible merchandise;
- Use sufficient padding when necessary;
- Seal packages securely;
- Remove or completely cover previous shipping labels and barcodes when reusing packaging;
- Securely attach the PLUR Market-provided shipping label; and
- Follow applicable PLUR Market or carrier packaging instructions.
Shipping insurance does not eliminate a trader's responsibility to package merchandise appropriately. Carrier or insurance claims may be denied when damage results from inadequate packaging or another excluded cause.
12. Required Use of PLUR Market Shipping Labels
Unless PLUR Market expressly authorizes otherwise, traders must use the shipping label provided or approved by PLUR Market.
Using an unauthorized shipping method, altering a shipping label, shipping to an address other than the address provided by PLUR Market, or shipping directly to the other trader may limit or eliminate protections otherwise available through the Protected Trades process.
PLUR Market may be unable to assist with tracking, verification, insurance, claims, or disputes involving shipments made outside the authorized Protected Trade process.
SHIPPING RISK
13. Shipping Risk and Third-Party Carriers
PLUR Market facilitates shipping for Protected Trades, but transportation services are performed by independent third-party shipping carriers.
Once a trader properly tenders a package to the designated shipping carrier for transportation to PLUR Market, the package is in the possession and control of that carrier while in transit.
Likewise, once PLUR Market properly tenders an outbound package to the designated carrier for delivery to the receiving trader, the package is in the possession and control of that carrier while in transit.
Shipping involves risks outside PLUR Market's direct control, including loss, theft, damage, delay, misdelivery, routing errors, weather events, carrier operational disruptions, and other transportation-related events.
To the fullest extent permitted by applicable law, PLUR Market is not responsible for loss, theft, damage, delay, misdelivery, or other shipping-related events occurring while merchandise is in the possession or control of a third-party shipping carrier, except to the extent caused by PLUR Market's own acts or omissions or where liability cannot legally be excluded.
This applies to both Trader → PLUR Market and PLUR Market → Receiving Trader shipments.
14. Shipping Insurance and Claims
Protected Trade shipments processed through PLUR Market include applicable shipping insurance, carrier protection, declared-value coverage, or other shipment protection as provided for the applicable shipment.
The existence of shipping insurance or protection does not guarantee that a claim will be approved or paid.
Coverage remains subject to the applicable carrier's or insurance provider's terms, exclusions, coverage limits, documentation requirements, filing deadlines, and claim determinations.
If merchandise is lost or damaged while in transit, PLUR Market may assist with or coordinate the applicable carrier or insurance claim.
Traders agree to reasonably cooperate with any claim investigation and provide requested information, which may include photographs, proof of merchandise value, purchase documentation if available, trade communications, packaging photographs, tracking information, descriptions of the merchandise, statements regarding the shipment, and other reasonably necessary documentation.
PLUR Market cannot guarantee that a carrier or insurer will approve a particular claim or pay a particular amount.
15. Receipt of Merchandise by PLUR Market
Delivery of merchandise to PLUR Market does not automatically mean that the merchandise has been accepted or approved for completion of the trade.
PLUR Market may inspect or review merchandise to determine whether it reasonably corresponds with the approved Trade Order.
PLUR Market will generally wait until both traders' items have arrived before completing the exchange or forwarding either item.
If one trader's merchandise arrives first, PLUR Market may hold it while waiting for the second shipment.
Nothing will be forwarded to either trader merely because one package arrives first.
16. Verification
PLUR Market's verification process is intended to determine whether the merchandise received reasonably corresponds with the approved Trade Order and information submitted for the transaction.
Verification may include reviewing item identity, artist or brand, size, apparent condition, material disclosed flaws, photographs, Trade Order information, and other relevant characteristics.
Verification is a marketplace protection measure and is not a professional appraisal, certification, grading service, forensic authentication, or guarantee of authenticity, quality, value, safety, or future condition.
PLUR Market does not guarantee that every defect, alteration, counterfeit characteristic, manufacturing issue, hidden flaw, or other condition will be detected.
17. Merchandise That Does Not Match the Approved Trade
Each trader must send
the merchandise represented and agreed upon in the approved Trade Order.
If merchandise received by PLUR Market materially differs from the approved Trade Order, PLUR Market may immediately pause the trade and investigate.
Material discrepancies may include:
- A different item;
- Incorrect size;
- Material undisclosed damage;
- A materially different condition;
- Missing components;
- Significant differences from submitted photographs;
- Significant differences from the agreed description;
- Suspected counterfeit or inauthentic merchandise;
- Evidence of tampering; or
- Another significant difference from the approved Trade Order.
PLUR Market may review the Trade Order, Trade Listings, photographs, communications, item descriptions, and other available information.
If PLUR Market reasonably determines that one trader submitted merchandise that materially does not match what they agreed to trade, PLUR Market may cancel the trade.
The trader PLUR Market reasonably determines to be responsible for the material discrepancy may be assessed the $40 Trade Cancellation/Resolution Fee.
The fee is intended to offset costs associated with resolving and unwinding the failed trade, including return shipping for both traders, shipping-label costs, payment-processing expenses, administrative expenses, and other related costs.
18. Disputes About What Was Agreed Upon
If either trader claims that merchandise received by PLUR Market is not the merchandise they agreed to receive, PLUR Market may pause the Protected Trade before either item is forwarded.
A trader's statement that an item is not what they agreed to receive does not automatically establish that the other trader violated these Trade Terms.
PLUR Market may review the approved Trade Order, Trade Listing, photographs, messages exchanged through PLUR Market, item descriptions, size information, condition disclosures, identifying information, and other relevant evidence.
If PLUR Market reasonably determines that a trader sent merchandise materially different from what that trader agreed to provide, PLUR Market may cancel the trade, return the merchandise as appropriate, and assess the responsible trader the $40 Trade Cancellation/Resolution Fee.
If the merchandise matches the approved Trade Order and the complaint instead results from a change of mind, trader's remorse, misunderstanding of accurately disclosed information, dissatisfaction with the agreed exchange, or another reason unrelated to a material discrepancy, the trade remains subject to the final-trade provisions of these Terms.
19. Prohibited Items
The following merchandise may not be offered or exchanged through PLUR Market Protected Trades:
- Counterfeit, replica, or intentionally misrepresented merchandise;
- Stolen merchandise;
- Merchandise obtained through fraud;
- Merchandise the trader does not have the legal right to possess or transfer;
- Firearms, ammunition, explosives, or prohibited weapons;
- Illegal drugs or controlled substances;
- Drug paraphernalia prohibited by applicable law;
- Hazardous, toxic, flammable, explosive, or otherwise dangerous materials that cannot lawfully or safely be shipped;
- Alcohol;
- Tobacco or nicotine products;
- Prescription medications;
- Items containing prohibited biological materials;
- Unlawful pornographic or sexually explicit material;
- Merchandise that unlawfully infringes intellectual-property rights;
- Items prohibited from transportation by the applicable shipping carrier;
- Items prohibited by applicable federal, state, or local law; and
- Any merchandise PLUR Market determines creates an unreasonable safety, legal, fraud, shipping, or marketplace risk.
PLUR Market may refuse, remove, return, or otherwise decline to process prohibited merchandise.
Where required by law, PLUR Market may provide information or prohibited merchandise to appropriate authorities.
A trader who sends prohibited merchandise may be responsible for resulting shipping, return, disposal, administrative, or other reasonable costs to the extent permitted by law.
20. Counterfeit and Suspected Inauthentic Merchandise
Traders may not knowingly offer counterfeit merchandise or intentionally misrepresent the authenticity or origin of merchandise.
If PLUR Market reasonably suspects that merchandise may be counterfeit, fraudulent, stolen, or otherwise unlawful, PLUR Market may pause or cancel the trade and request additional information.
PLUR Market may restrict the associated account or take other action permitted under its marketplace policies.
PLUR Market's decision to allow merchandise to proceed through the Protected Trade process is not a certification or guarantee that the merchandise is authentic.
21. No Direct Exchange or Circumvention
Protected Trades are designed around PLUR Market acting as an intermediary.
Users must not misuse the Protected Trade system to arrange an exchange and then intentionally circumvent PLUR Market's process, fees, verification procedures, or marketplace protections.
If traders elect to transact or ship outside PLUR Market's authorized Protected Trade process, PLUR Market may be unable to provide verification, shipping protection, insurance assistance, claim assistance, dispute assistance, or other Protected Trade protections.
Circumvention may result in cancellation of the Trade Order or restrictions on the users' accounts.
22. Address Information and Undeliverable Packages
Each trader is responsible for maintaining accurate shipping and contact information.
PLUR Market is not responsible for delivery problems caused by inaccurate, incomplete, outdated, or improperly submitted address information supplied by a trader, except where required by applicable law.
If a shipment is refused, returned, undeliverable, or requires reshipment because of information or conduct attributable to a trader, that trader may be responsible for reasonable additional shipping or handling costs.
FINAL TRADE POLICY
23. ALL COMPLETED TRADES ARE FINAL — NO RETURNS OR EXCHANGES
ALL COMPLETED PROTECTED TRADES ARE FINAL.
Traders are responsible for confirming exactly what they are agreeing to send and receive before submitting or agreeing to a Trade Order.
Once both items have been received and verified by PLUR Market and PLUR Market has completed the exchange by forwarding the respective merchandise to their new owners, the trade is final.
PLUR Market does not offer returns, exchanges, refunds, or trade reversals for completed Protected Trades merely because a trader changes their mind, no longer wants the merchandise, dislikes the fit, decides they preferred their original merchandise, believes they made an unfavorable trade, misunderstood information that was accurately disclosed before agreeing to the trade, or otherwise experiences trader's remorse.
Each trader is responsible for reviewing photographs, sizing information, descriptions, condition disclosures, known flaws, and other material information before agreeing to the Trade Order.
If merchandise received by PLUR Market materially differs from the approved Trade Order, the matter should be raised and resolved before PLUR Market forwards the merchandise whenever reasonably possible.
Once verification is completed and PLUR Market forwards the merchandise to the respective new owners, the completed trade is not eligible for a return, exchange, refund, or reversal, except where required by applicable law or expressly authorized by PLUR Market under extraordinary circumstances.
Nothing in these Trade Terms waives rights that cannot legally be waived.
24. Change of Mind Before Payment or Shipment
Submitting or agreeing to a Trade Order should be treated as a commitment to complete the agreed exchange.
Traders should not submit or agree to a Trade Order unless they are prepared to complete the transaction.
If a trader does not complete their initial Stripe payment and no shipping labels have been issued, PLUR Market may cancel the Trade Order without assessing the $40 Trade Cancellation/Resolution Fee solely because of that failure to pay.
If the other trader has already paid, their payment will be refunded or voided as applicable.
Once both traders have paid and PLUR Market has issued shipping labels, both traders are expected to complete the transaction. A trader who subsequently abandons the trade or fails to ship may be subject to the
$40 Trade Cancellation/Resolution Fee.
If circumstances arise that prevent completion of a trade, contact PLUR Market as soon as possible at
[email protected].
25. Problems After Delivery
A trader who believes there is a material issue with merchandise received through a completed Protected Trade should contact PLUR Market promptly at
[email protected] and provide photographs and other requested information.
PLUR Market may review the circumstances. However, reporting an issue after delivery
does not automatically create a right to a return, refund, reversal, replacement, or exchange.
The final-trade provisions of these Trade Terms continue to apply except where required by applicable law or PLUR Market determines that extraordinary circumstances warrant another resolution.
26. Lost, Damaged, or Delayed Shipments
If a shipment is lost, damaged, or materially delayed while in a carrier's possession, PLUR Market may assist with the applicable carrier or insurance process.
Resolution may depend upon the carrier's investigation and applicable insurance or shipping-protection terms.
A shipping incident affecting one side of a trade may require PLUR Market to place the entire trade on hold until the matter is resolved.
PLUR Market may determine the appropriate next procedural step based on the circumstances, location and condition of the merchandise, available tracking information, carrier information, insurance determinations, documentation provided by the traders, and applicable marketplace policies.
27. Fraud, Abuse, and Misconduct
The following conduct is prohibited:
- Knowingly submitting false information;
- Shipping merchandise different from the approved merchandise;
- Concealing material damage or defects;
- Manipulating photographs or descriptions to misrepresent merchandise;
- Shipping an empty package;
- Falsifying tracking or shipping information;
- Making fraudulent carrier or insurance claims;
- Payment fraud;
- Fraudulent chargebacks;
- Harassing, threatening, or attempting to defraud another user;
- Circumventing applicable PLUR Market fees or protections;
- Manipulating the Protected Trade process; or
- Otherwise using the service unlawfully or deceptively.
PLUR Market may investigate suspected misconduct.
Where appropriate, PLUR Market may pause a trade, cancel a trade, assess applicable fees, restrict Protected Trade privileges, remove listings, suspend or terminate an account, preserve relevant records, or take other reasonable action permitted by applicable law and PLUR Market policies.
28. Chargebacks and Payment Disputes
Users should contact PLUR Market regarding a trade-related billing or transaction problem before initiating a payment dispute.
Nothing in these Trade Terms prevents a user from exercising legitimate rights available through their payment provider or applicable law.
However, knowingly filing a false or misleading chargeback, falsely claiming that an authorized charge was unauthorized, or otherwise abusing a payment-dispute process may result in account restrictions and appropriate recovery efforts to the extent permitted by law.
29. PLUR Market's Role
PLUR Market operates a marketplace and facilitates Protected Trades between users.
Unless PLUR Market is expressly identified as the owner or seller of particular merchandise, PLUR Market does not own merchandise being exchanged between traders.
PLUR Market is not the manufacturer, artist, designer, original retailer, original seller, or shipping carrier for user-submitted merchandise.
PLUR Market's temporary possession, inspection, verification, or forwarding of merchandise as part of a Protected Trade does not make PLUR Market the original seller of that merchandise.
30. No Guarantee of Merchandise Value
Trade values displayed, discussed, estimated, or entered on PLUR Market are not professional appraisals.
PLUR Market does not guarantee that merchandise exchanged through Protected Trades has equal monetary value, equal resale value, equal rarity, equal collectability, or any particular future value.
Each trader is responsible for determining whether the proposed exchange is acceptable to them before agreeing to the Trade Order.
A difference in perceived or actual market value after a trade has been agreed upon does not, by itself, create a right to cancel or reverse the trade.
31. Limitation of Liability
To the fullest extent permitted by applicable law, PLUR Market will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to a Protected Trade, including lost profits, lost opportunities, loss of use, or loss of anticipated value.
To the fullest extent permitted by applicable law, PLUR Market's liability relating to a Protected Trade will be limited as provided by PLUR Market's applicable Terms of Service and any mandatory rights available under applicable law.
Nothing in these Trade Terms excludes or limits liability that cannot legally be excluded or limited.
32. Indemnification
To the fullest extent permitted by applicable law, users agree to indemnify and hold harmless PLUR Market LLC and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, losses, and reasonable costs arising from a user's violation of these Trade Terms, unlawful conduct, fraudulent activity, infringement of another person's rights, or merchandise submitted by the user through the Protected Trade service.
Any indemnification obligations are subject to applicable law and PLUR Market's general Terms of Service.
33. PLUR Market's Right to Pause or Cancel a Trade
PLUR Market may pause, reject, or cancel a Protected Trade when reasonably necessary, including when:
- One trader fails to make the required payment;
- One trader fails to ship after labels have been issued;
- Merchandise does not match the approved Trade Order;
- The traders dispute what was agreed upon;
- Merchandise is lost or damaged;
- A prohibited item is submitted;
- Fraud or misconduct is suspected;
- Shipping or verification cannot reasonably be completed;
- A legal or safety concern exists; or
- Continuing the transaction would materially threaten the integrity of the Protected Trade process.
PLUR Market will determine the appropriate handling of merchandise already in its possession based on the circumstances and applicable law.
When a trader's violation or failure after shipping labels have been issued causes the trade to be cancelled or unwound,
the responsible trader may be assessed the $40 Trade Cancellation/Resolution Fee and other costs expressly permitted under these Trade Terms and applicable law.
If a trade is cancelled solely because one trader failed to complete the initial required payment before shipping labels were issued, Section 8 applies and neither trader will be charged for that cancelled trade.
34. Returning Merchandise After a Failed Trade
If an approved Protected Trade cannot be completed after one or both traders have shipped merchandise to PLUR Market, PLUR Market may arrange for the merchandise to be returned to its respective original owners.
When the failure results from a trader's failure to ship after labels were issued, submission of materially nonconforming merchandise, unauthorized cancellation, violation of these Trade Terms, or other conduct attributable to that trader, PLUR Market may assess that responsible trader the $40 Trade Cancellation/Resolution Fee.
The fee is intended, in part, to offset the cost of returning merchandise to both traders and other expenses incurred in resolving or unwinding the transaction.
PLUR Market may determine the appropriate return-shipping method based on the merchandise, circumstances, carrier availability, and other relevant factors.
35. Account Enforcement
Violation of these Trade Terms may result in one or more of the following:
- Warning;
- Cancellation of a trade;
- Assessment of applicable fees;
- Restriction of Protected Trade privileges;
- Removal of listings;
- Temporary account suspension;
- Permanent account termination; or
- Other reasonable action permitted under PLUR Market's policies and applicable law.
Enforcement decisions may take into account the severity, frequency, circumstances, and history of the violation.
36. Changes to These Trade Terms
PLUR Market may update these Trade Terms from time to time.
When material changes are made, PLUR Market may provide notice through the website, account interface, email, or another reasonable method.
The version applicable to a particular Protected Trade will generally be the version in effect when the applicable Trade Order is submitted or otherwise accepted, subject to changes required by law or expressly agreed to by the participants.
37. Governing Terms and Applicable Law
These Trade Terms are governed together with PLUR Market's general Terms of Service, including any applicable provisions concerning governing law, dispute resolution, arbitration, venue, class-action waivers, or other legal procedures.
Nothing in these Trade Terms limits any consumer right or remedy that cannot lawfully be waived.
38. Severability
If any provision of these Trade Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.
The remaining provisions will continue in full force and effect.
39. No Waiver
PLUR Market's decision not to enforce a provision of these Trade Terms in a particular circumstance does not waive PLUR Market's right to enforce that provision in another circumstance.
Any waiver must be authorized by PLUR Market.
40. Entire Protected Trade Agreement
These Trade Terms, the applicable Trade Order, PLUR Market's general Terms of Service, Privacy Policy, and any other policies expressly incorporated into the transaction constitute the applicable terms governing participation in PLUR Market Protected Trades.
